3. Freight Services Terms & Conditions

These Freight Services Terms & Conditions establish general conditions applicable to freight transportation requested from Blue Ridge Transportation when properly incorporated into the parties’ transportation transaction, unless superseded by a separately executed agreement, applicable bill of lading, rate confirmation, tariff, or other written agreement.

Shipment Acceptance

A website inquiry or quote request does not constitute acceptance of freight.

Blue Ridge Transportation reserves the right to accept or decline requested transportation based on equipment availability, operational requirements, commodity, shipment characteristics, safety considerations, legal requirements, insurance limitations, and other legitimate business considerations.

Customer Information

The customer is responsible for providing accurate shipment information, including commodity, quantity, dimensions, weight, origin, destination, pickup requirements, delivery requirements, special handling requirements, and any hazardous or regulated characteristics.

Additional charges may apply when actual shipment conditions differ from the information provided when the quote was prepared.

Rates

Quoted rates apply only to the shipment and conditions described in the applicable quote.

Unless otherwise stated in writing, quoted rates may exclude additional services or circumstances including:

  • Detention
  • Layover
  • Additional stops
  • Redelivery
  • Storage
  • Lumper charges
  • Tolls
  • Special equipment
  • Driver assistance
  • Excessive waiting time
  • Reconsignment
  • Shipment changes
  • Other accessorial services

Applicable charges should be identified in shipment documentation or agreed to between the parties when reasonably practicable.

Detention and Delays

Detention or other accessorial charges may apply when a vehicle or driver is delayed beyond the applicable free-time period stated in the quote, rate confirmation, customer agreement, or Blue Ridge Transportation policy.

Blue Ridge Transportation will make reasonable efforts to communicate material delays.

Pickup and Delivery Times

Pickup, delivery, and transit estimates are not guaranteed unless Blue Ridge Transportation expressly agrees in writing to guaranteed service.

Transportation may be affected by traffic, weather, road closures, mechanical conditions, shipper or receiver delays, governmental action, emergencies, safety considerations, and other circumstances outside reasonable control.

Safety and legal compliance take priority over requested transit schedules.

Cargo Preparation

Unless otherwise agreed in writing, the shipper is responsible for properly packaging, marking, labeling, preparing, and accurately describing freight for transportation.

Freight must be suitable for the requested transportation equipment and comply with applicable law.

Prohibited and Restricted Freight

Blue Ridge Transportation may refuse commodities that are unlawful, unsafe, improperly packaged, inaccurately described, outside applicable insurance coverage, or incompatible with assigned equipment.

Hazardous materials, controlled commodities, unusually high-value cargo, or other specially regulated freight must be disclosed before booking and may require prior written approval.

Changes and Cancellations

Customers should promptly notify Blue Ridge Transportation of shipment changes or cancellations.

Charges may apply when a vehicle has been dispatched, positioned, committed to the shipment, or otherwise incurred expenses before a cancellation or material change.

Any applicable truck-ordered-not-used, cancellation, deadhead, or related charge will be governed by the applicable quote, rate confirmation, customer agreement, or other written terms.

Bills of Lading

Shipping documents should accurately identify the parties, commodity, quantity, condition when applicable, origin, destination, and other required shipment information.

A bill of lading or shipping document does not automatically modify separately agreed pricing or contractual terms unless applicable law or a written agreement provides otherwise.

Cargo Claims

Loss or damage should be reported to Blue Ridge Transportation as promptly as practicable.

Cargo claims must contain sufficient information to identify the shipment, establish the nature of the claimed loss or damage, and state the amount claimed.

Cargo claims and carrier liability are subject to applicable federal or state law, contractual provisions, bills of lading, and other governing transportation documents.

Nothing on this website is intended to waive rights or obligations established by applicable transportation law.

Payment

Payment terms will be stated on the applicable invoice, credit agreement, rate confirmation, customer agreement, or other written documentation.

Customers are responsible for charges properly incurred in connection with requested transportation services.

4. Business Partner Standards & Ethical Transportation

Our Commitment

Blue Ridge Transportation believes that how freight moves matters just as much as where it goes.

We are committed to operating with integrity, respect for human dignity, safety, fairness, and responsible business practices throughout our transportation network.

When a customer, shipper, receiver, broker, vendor, or other business partner enters into a transportation transaction with Blue Ridge Transportation that incorporates these Freight Services Terms & Conditions, that party agrees to conduct its interactions with Blue Ridge Transportation, our employees, drivers, contractors, and representatives consistently with the following standards.

Human Trafficking and Exploitation

Blue Ridge Transportation maintains a zero-tolerance position toward human trafficking, forced labor, commercial sexual exploitation, and other forms of human exploitation.

Business partners may not knowingly use Blue Ridge Transportation services in furtherance of trafficking, exploitation, forced labor, or other unlawful activity.

Blue Ridge Transportation may refuse or discontinue service when we reasonably believe transportation is being requested in connection with unlawful exploitation or when continuing the transaction would conflict with applicable law or our safety obligations.

Suspected criminal activity may be reported to appropriate authorities when warranted or required by law.

Respect for Professional Drivers and Transportation Personnel

Professional drivers are essential transportation professionals and must be treated with dignity and respect.

Customers, shippers, receivers, brokers, vendors, and other parties interacting with Blue Ridge Transportation are expected to provide a professional and reasonably safe environment for our personnel.

Harassment, unlawful discrimination, threats, intimidation, violence, retaliation, or abusive treatment directed toward Blue Ridge Transportation personnel is not acceptable.

Blue Ridge Transportation reserves the right to address inappropriate conduct, remove personnel from unsafe circumstances, decline future service, or terminate a business relationship when reasonably necessary to protect our employees, drivers, contractors, or operations and consistent with applicable contractual and legal obligations.

Nondiscrimination and Human Dignity

Blue Ridge Transportation is committed to treating people fairly and respectfully without unlawful discrimination.

We expect business partners interacting with our personnel to maintain professional conduct and refrain from unlawful discrimination or harassment.

The people and communities involved in transportation come from different backgrounds and experiences. Respect for human dignity is a basic expectation of doing business with Blue Ridge Transportation.

Safe and Lawful Transportation

No shipment, deadline, rate, customer request, or business relationship takes priority over safe and lawful operation.

Business partners may not knowingly direct, encourage, pressure, or retaliate against Blue Ridge Transportation personnel for refusing to violate applicable transportation or safety requirements.

This includes requirements concerning:

  • Hours of service
  • Vehicle safety
  • Weight restrictions
  • Cargo securement
  • Hazardous materials
  • Licensing
  • Driver qualification
  • Medical qualification
  • Equipment limitations
  • Other applicable transportation regulations

Blue Ridge Transportation may delay, modify, or decline transportation when reasonably necessary for safe or lawful operation.

Ethical Business Practices

Blue Ridge Transportation expects honesty and good-faith dealing throughout the transportation process.

Fraud, bribery, intentional misrepresentation of freight, falsification of transportation documents, deliberate concealment of hazardous or restricted commodities, cargo theft, trafficking, or other unlawful conduct is prohibited in connection with our services.

Right to Decline or Discontinue Business

Blue Ridge Transportation reserves the right, consistent with applicable contractual and legal obligations, to decline, suspend, or discontinue a business relationship when conduct materially conflicts with these standards, threatens the safety or dignity of our personnel, involves suspected unlawful activity, or creates an unreasonable legal or operational risk.

These standards establish expectations for parties doing business with Blue Ridge Transportation. They do not require a business partner to adopt Blue Ridge Transportation’s internal employment policies, religious beliefs, organizational culture, or viewpoints.

5. Additional Freight Provisions

Force Majeure and Circumstances Beyond Reasonable Control

Blue Ridge Transportation will not be responsible for delays or failures caused by circumstances beyond its reasonable control to the extent permitted by applicable law.

Such circumstances may include severe weather, natural disasters, road closures, governmental actions, civil emergencies, labor disruptions, infrastructure failures, or other extraordinary events.

Governing Law

Except where federal transportation law controls or the parties agree otherwise in writing, these terms are governed by applicable law of the State of Tennessee.

Relationship to Other Agreements

If a customer has entered into a separate written transportation agreement with Blue Ridge Transportation, that agreement controls to the extent it conflicts with these general Freight Services Terms & Conditions.
